Don't Tread on Me: A Petition to Change Vehicle Import Laws

For the past 12 years I have been working with vehicle import to the United States. It's an odd thing, a difficult path to navigate, but I have spent a lot of time with the Code of Federal Regulations, and a good amount of time at the NHTSA/OVSC offices in Washington, DC. It is in my nature to question things that just don't make sense to me, and a lot of things to do with vehicle importation don't make a lot of sense. 25 years seems like an arbitrary number. Why is the DOT/NHTSA exemption for vehicles 25 years?

The even odder part about the 25 year requirement, is that while the DOT/NHTSA requirement is 25 years, the EPA's requirement is 21 years. At 25 years you no longer need to meet specific requirements for importation, and can import anything you want. The same is true at 21 years for the EPA requirements. Each State then has its specific requirements for registration, but the Federal Government is satisfied.
Canada has similar requirements on the books, but it is a 15 year exemption. So for the last seven years, the Canucks have been importing some of the really "cool" JDM cars, like 1989 Nissan Skylines. As each year progresses they are able to import progressively newer models years, to the point that they are now able to legally import the 1995 Skyline R33 GT-R, Silvias, Crowns, Diesel Landcruisers, Soarers, and tons of other vehicles.

The real reason that vehicles are not allowed to be imported has very little to do with safety, and more to do with lobbying power. I wrote a blog post earlier this year, giving my explanation on why the Nissan Skyline was illegal in the US. Though the years, I have heard all kinds of reasons, from all kinds of people, but about 99.9% of what you hear is bullshit.

"The grey market was successful enough that it ate significantly into the business of Mercedes-Benz of North America and their dealers. The corporation launched a successful million-dollar congressional lobbying effort to stop private importation of vehicles not officially intended for the U.S. market. An organisation called AICA (Automotive Importers Compliance Association) was formed by importers in California, Florida, New York, Texas, and elsewhere to counter some of these actions by Mercedes lobbyists, but the Motor Vehicle Safety Compliance Act was passed in 1988, effectively ending private import of grey-market vehicles to the United States. No evidence was presented that grey-import vehicles' safety performance differed significantly from that of US models, and there have been allegations of improper lobbying, but the issue has never been raised in court."

So down to brass tacks, and this particular petition. Most petitions I just ignore, because there is nothing behind them. No way to officially present it to anyone that can do anything about it. However, this particular one caught my attention. Toby Yim posted it to my Facebook page, and Jordan Watson got behind it to spread it. It seemed interesting that it was on the White House site, and that it had a chance at an official response. 25,000 signatures is not a goal, 25,000 signatures is the start.
Head over sign up, sign in, and put your name on it. The laws can be changed, and this is just one step, but in order to do so, a lot more will have to be done. Anything is possible, it just all requires effort from more than a few people.

What we really need is about 1,000 people a day signing the petition. People forget, mean to do it, don't get around to it, so the people that care, and are trying to make it happen, have to make sure those people sign up. It Just takes a couple minutes, and it might be the start of a movement.
We need to leverage social media. We need to leverage those email lists. We need to leverage those blogs. We need to leverage those forums. Car enthusiasts need to be a little more vocal. Don't let the few loud, over power us quiet many. We get pushed around doing what we enjoy doing. The "green" movement seems like it might be strong, but we need to be stronger.

I signed it. However I think the better solution is not to simply change the year, but maybe tweak the tariff laws to make it more competitive for Europeans to import their cars. A $12K difference would make a person buy the gray market car, but a $2-5K difference would be worth the warranty for some people. Plus it would allow the foreign OEMs to sell more of their cool, cheap cars here.

Thanks for posting. This petition is just the start of something. Its to get the word out, and pose some questions. So far its been picked up by Inside Line, Autoblog, and Jalopnik, along with a ton of other websites. As I said above, car enthusiasts need to be a little more vocal, be a little more involved. You hear the stories of communities complaining about race tracks, that were there years before these local people moved around them. Laguna Seca, Pomona, Altamont. Things that happen, like what happened with street legal drags at Pomona are a joke. We can get people to go out to the shows, to go to those kinds of things, but to enjoy some of those hobbies, they also need to be willing to put in a little bit of work, to ensure they are going to be able to keep doing it in the future.

Signed. Think not only of the cool Japanese cars we could get, but also the cool Euro cars (1995-ish M3 CSL) we could get as well. Plus, resale value on euro cars is incredibly low, especially diesels.

Need about 750 signatures a day. Again, this is just the start. 25k means a response. I can build on a response. I can argue a response.

We need Motoiq and those other sites to kick these articles to the top of their daily posting for the next few weeks. Titles like "How to legally get your R32 Skyline or Turbo Diesel Land Cruiser 10 YEARS earlier!" might help as well. I don't visit any diesel sites (Steve?) but this seems like something those guys would rally around if we were to list a few of the Turbo Diesel cars and SUVs they could finally get imported (3 series diesels). I'd think the Euro guys would bite off as well as soon as I thought of those BMW diesels.

I just helped to import a 25 year old Toyota BJ40 diesel Landcruiser. Came in though Long Beach. Did the right paperwork, and no issues. Its a cool old truck, but 10 years newer would be much better. The petition is just the start of a change. If enough people are interested, the laws can be changed. After the 25 Hour race this weekend, I am going to take some time to dedicate to this project.

Recently I had someone pick me up a copy of the FIA Homologation paperwork for the R32 GT-R. The paperwork contained lots of interesting pictures and information, and also part of my basis for my application for Show or Display. So with the 21st birthday of the Nismo R32 come and gone, I wrote up a cover letter, put it together with some pictures, the FIA homologation paperwork on the car, and sent it to the NHTSA in Washington, DC. I gave it about a month and called the NHTSA to check the progress of the application, left a voicemail. Nothing. About a week later, called again left another voicemail, nothing. This is to be expected. As with any government agency, you can hardly expect them to call you back, to give you an update on a project. Even if you leave them your phone number, email address, and call several times over a several week time frame. Another month goes by. Call a few more times, leave some more voicemails. Maybe, they might think, that I will give up. I have other things to do, but I am just doing this to prove a point. The NHTSA has already set a precedent with the Nissan Skyline GT-R and Show or Display. They approved a 1999 Nissan Skyline GT-R Vspec "early version". Interesting, I consider myself to be pretty well versed in the Nissan GT-R, and especially the R34, and I have never heard of that car. Its December 2011, I am sick of waiting. I can't say I have been following up on this much. I have called and left a few messages in the last few weeks, with of course, no response. I pretty much put it though as a lost cause, so the best course of action, would be to ask all of you to call up Dick Merritt, call up his boss Coleman Sachs, and ask whats going on. If this was your job to answer applications like this you would have been fired long ago. No official answers. No official questions. Nothing. Just them repeating that Nissan Skyline is a dirty word.

I am almost certain now, the answer will be no. However, we will all know the real reason it will be no, is nothing more than the whim of Dick Merritt and others at the NHTSA/DOT/ OVSC. Share this everywhere you can.

It takes a lot of work to make it happen. I have been working on this stuff for over 12 years now. When I have time I work on it, otherwise other things take priority.
